Terms of Service
Please read these Terms of Service ("Terms") carefully before using JigSpot. By creating an account or using the app, you agree to be bound by these Terms. If you do not agree, do not use JigSpot.
1. About JigSpot
JigSpot is a Progressive Web App (PWA) that provides offline bathymetric maps, GPS tracking, fishing spot management, and friend location sharing for anglers in Philippine waters. The service is operated by Diomari Madulara ("Operator"), based in Davao de Oro, Philippines.
2. Eligibility
You must be at least 13 years old to use JigSpot. By registering, you confirm that the information you provide is accurate and that you are legally capable of entering into these Terms.
3. Your Account
- You are responsible for keeping your password secure and for all activity under your account.
- Notify us immediately at jigspot@diom.dev if you suspect unauthorized access to your account.
- Do not share your login credentials or create accounts on behalf of others without their consent.
4. Acceptable Use
You agree not to:
- Use JigSpot for any unlawful purpose or in violation of Philippine law, including the Fisheries Code (RA 10654) or local ordinances on fishing areas.
- Attempt to reverse-engineer, decompile, or extract source code from the app.
- Upload false, misleading, or harmful content to the service.
- Interfere with or disrupt the service's infrastructure.
- Share another user's location data obtained through the broadcast feature without their consent.
5. Service Plans
JigSpot offers a free tier and a premium tier. Premium features include expanded offline map downloads, unlimited spot storage, broadcast location sharing, and access to premium map layers. Feature availability for each tier may change over time. We will provide reasonable notice of any changes that reduce free-tier functionality.
Payment terms, pricing, and refund conditions for premium subscriptions are described in the app at the time of purchase and are subject to applicable Philippine consumer protection law.
6. GPS and Map Data
JigSpot provides bathymetric depth data, contour lines, and GPS tracking as navigational aids only. This data is not a substitute for official nautical charts or professional marine navigation equipment. Depth readings are derived from GEBCO global ocean data and may not reflect actual conditions at a specific location. Always follow safe boating practices and comply with local maritime regulations.
GPS accuracy depends on your device hardware and signal conditions. JigSpot does not guarantee the accuracy of your recorded position or depth readings.
7. Location Sharing (Broadcast)
The broadcast feature shares your real-time GPS coordinates with friends you have accepted within the app. By enabling broadcast, you consent to this sharing. You can disable broadcast at any time from the map screen. You are responsible for choosing which friends can see your location.
8. User Content
Fishing spot names, notes, and other content you create in JigSpot belong to you. By storing this content in the service, you grant us a limited license to process and sync it as necessary to provide the service. We do not claim ownership of your content.
9. Intellectual Property
The JigSpot name, logo, app design, and code are the intellectual property of Diomari Madulara. You may not reproduce or distribute any part of the service without written permission. Bathymetric data is sourced from GEBCO (General Bathymetric Chart of the Oceans) and is used under their open data license.
10. Disclaimer of Warranties
JigSpot is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or uninterrupted availability. We do not warrant that the app will be error-free or that depth data will be accurate at any specific location.
11. Limitation of Liability
To the fullest extent permitted by Philippine law, the Operator shall not be liable for any indirect, incidental, or consequential damages arising from your use of JigSpot, including but not limited to navigation errors, loss of fishing spots, or decisions made based on depth data displayed in the app. Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in abusive behaviour, or if we discontinue the service. You may delete your account at any time by contacting us. Upon termination, your data will be handled in accordance with our Privacy Policy.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified in the app at least 7 days before they take effect. Continued use of JigSpot after that date constitutes acceptance of the revised Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from your use of JigSpot shall first be attempted to be resolved amicably. If unresolved, disputes shall be submitted to the proper courts of Davao de Oro, Philippines.
